Terms of Service
The agreement between you and MarriageEmporium.
Welcome to MarriageEmporium. These Terms of Service (“Terms”) are a legally binding agreement between you and MarriageEmporium (“MarriageEmporium,” “we,” “our,” or “us”) governing your access to and use of www.marriageemporium.com, any related applications, and all related features and services (collectively, the “Services”). Our Privacy Policy and Payment Policy are incorporated into these Terms by reference.
By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Three things to know before you read on. The profile we call a “marriage contract” is not a legally binding agreement (Section 2). We do not screen members unless you buy a background check, and a verified badge is not a guarantee (Section 4). Disputes are resolved by individual arbitration and you waive class actions and jury trial, unless you opt out within 30 days (Section 17). This summary is for orientation only and does not replace the sections it points to.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Services. By registering, you represent and warrant that: (a) you meet the age requirement; (b) all information you provide is accurate, current, and complete, and you will keep it so; (c) you are legally free to marry (or, where applicable, to pursue a lawful marriage under the laws that apply to you) and are not using the Services to facilitate bigamy or any unlawful arrangement; (d) you have not previously been removed or banned from the Services; (e) you have not been convicted of a felony or any crime involving violence, sexual misconduct, fraud, or exploitation, and are not required to register as a sex offender, or, where applicable law requires, you will truthfully provide any history required by the International Marriage Broker Regulation Act or similar laws; and (f) you are not located in, a national of, or ordinarily resident in a country or region subject to comprehensive sanctions, and are not on any government sanctions or restricted-party list. We may refuse, suspend, or terminate access where we reasonably believe any of these representations is untrue.
2. The Nature of the Services — Please Read Carefully
MarriageEmporium is a technology platform, not a party to your relationships. We provide tools that help adults define, discover, and discuss the marriage they intend to build. You acknowledge and agree that:
- The “marriage contract” is not a legal contract. The profile feature we call a “marriage contract” is a statement of intentions and preferences. It is not a legally binding agreement, not a prenuptial agreement, not an offer capable of acceptance, and creates no legal rights or obligations between members or between any member and MarriageEmporium. If you want a legally enforceable prenuptial or marital agreement, consult a licensed attorney in the relevant jurisdiction.
- We are not a matchmaking guarantor, broker of outcomes, or escort or introduction agency. We do not arrange marriages, guarantee any match, meeting, relationship, or marriage, and we are not responsible for whether any introduction leads to any outcome.
- We are not a party to member dealings. Any communication, negotiation, meeting, relationship, engagement, or marriage is solely between the members involved. We have no obligation to mediate disputes between members, though we may do so at our discretion.
- No professional advice. Readiness tests, compatibility scores, reports, and any content we provide are informational tools, not medical, psychological, legal, financial, or immigration advice. Counselors and similar professionals accessible through the Services are independent third parties and not our employees or agents; we are not responsible for their advice, acts, or omissions.
3. Your Account
Your account is personal to you and may not be transferred or shared. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at customerservices@marriageemporium.com of any unauthorized use or security breach. We are not liable for losses caused by your failure to safeguard your credentials. You may not create more than one account, and we may suspend duplicate accounts.
4. Identity Verification and Background Checks — No Guarantee
We may offer identity-verification steps and optional background checks. These are screening tools with inherent limitations: verification can be defeated by sophisticated fraud, databases can be incomplete or out of date, and a verified badge or a completed background check is not a guarantee of a member’s identity, character, honesty, criminal history, marital status, or intentions. Except where you purchase a background-check service, we do not conduct criminal background checks or screenings on members. You are solely responsible for your own due diligence. Background checks, where offered, are performed by independent third-party providers with the member’s consent and may be governed by additional laws (including, in the United States, the Fair Credit Reporting Act).
5. Safety and Your Responsibilities
You are solely responsible for your interactions with other members, online and offline. You agree to exercise caution and good judgment, including: keeping communications on the platform until you are comfortable; never sending money, gift cards, or financial information to another member; researching any person independently before meeting; meeting in public places and telling a friend or family member your plans; and reporting suspicious behavior to us. We are not responsible for the conduct of any member, online or offline. Any in-person meeting is at your own risk. If you believe you are in immediate danger, contact local law enforcement first.
Safety notification: MarriageEmporium does not conduct criminal background screenings on its members unless expressly purchased as a separate service. To report abuse, harassment, suspected fraud, or requests for money, use the in-Service reporting tools or email customerservices@marriageemporium.com.
6. International Introductions (IMBRA and Similar Laws)
If you are a United States citizen or resident using the Services to communicate with members in other countries, the International Marriage Broker Regulation Act (“IMBRA”) and similar laws in other jurisdictions may apply. Where required, before we facilitate the exchange of personal contact information between a U.S. client and a foreign member, we may collect from the U.S. client certain criminal and marital history information and share required disclosures with the foreign member in their primary language, and the foreign member must affirmatively consent before contact information is exchanged. You agree to provide truthful information for these purposes and not to circumvent these safeguards.
7. Acceptable Use
You agree to use the Services only for their intended, marriage-oriented purpose and in compliance with these Terms and all applicable laws. You agree not to:
- Harass, threaten, stalk, abuse, defame, or harm any person, or promote discrimination, hatred, or violence.
- Impersonate any person or entity, misrepresent your identity, age, marital status, or circumstances, or create a profile for anyone other than yourself.
- Request, solicit, or send money, gifts, loans, investments, or financial favors to or from other members (including any “romance scam” or advance-fee conduct), or use the Services for escort services, prostitution, commercial sexual services, or any form of compensated companionship.
- Use the Services to facilitate human trafficking, exploitation, forced marriage, servitude, or immigration or visa fraud, or any arrangement in which marriage is exchanged for money, residency, or citizenship.
- Post or share content that is unlawful, defamatory, obscene, pornographic, sexually explicit, threatening, or otherwise objectionable, or that infringes any intellectual-property, privacy, publicity, or other right of any person.
- Solicit personal contact information to circumvent platform safeguards (including the safeguards in Section 6), harvest or scrape member data, or use bots, crawlers, or automated tools to access the Services.
- Circumvent or attempt to circumvent any safety, verification, payment, or access controls; probe or test vulnerabilities; or interfere with the operation of the Services.
- Use the Services for any commercial purpose not expressly authorized by us in writing, including advertising, recruiting, or solicitation.
- Encourage or assist anyone else in doing any of the above.
We may investigate violations, remove content, suspend or terminate accounts, withhold or revoke verification status, report conduct to law enforcement, and pursue any available legal remedy, in each case at our sole discretion and without notice where legally permitted.
8. User Content
Your content. You retain ownership of the content you submit, post, or transmit through the Services (“User Content”). By submitting User Content, you grant MarriageEmporium a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting and display), adapt, publish, translate, and display your User Content solely for the purpose of operating, providing, securing, and improving the Services — including displaying your profile and marriage contract to other members. This license ends for specific content when you delete it or your account, except (a) to the extent the content was shared with others who have not deleted it, (b) for residual backup copies removed on our normal schedule, and (c) where retention is required for legal, safety, or fraud-prevention purposes.
Your representations. You represent and warrant that you own or have all necessary rights to your User Content and that it does not violate these Terms or any law or third-party right.
Our moderation rights. We may (but are not obligated to) review, refuse, remove, or restrict any User Content at our discretion, including content reported by other members. We do not endorse, verify the accuracy of, or assume liability for any User Content.
Feedback. If you send us ideas or suggestions about the Services, you grant us the right to use them without restriction or compensation to you.
9. Copyright — DMCA Notice and Takedown
We respect intellectual-property rights. If you believe content on the Services infringes your copyright, send a notice to customerservices@marriageemporium.com with the subject line “DMCA Notice,” including: (a) identification of the copyrighted work; (b) identification and location (URL) of the allegedly infringing material; (c) your name, address, and email; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act; and (f) your physical or electronic signature. We will respond to compliant notices in accordance with the U.S. Digital Millennium Copyright Act and maintain a policy of terminating repeat infringers in appropriate circumstances.
10. Memberships and Payments
Paid memberships (Bronze, Silver, Gold, Platinum) and optional services are governed by our Payment Policy, which is incorporated into these Terms. By making a purchase, you agree to provide accurate billing information and authorize recurring charges as described in the Payment Policy.
11. Communications
By creating an account, you consent to receive service-related communications from us (account, security, match, message, billing, and policy notices) by email, in-Service notification, or push notification. Where required by law, marketing communications are sent only with your consent, and you may opt out at any time through your notification settings or the unsubscribe link; service-related communications cannot be opted out of while your account is active. Standard carrier rates may apply.
12. Our Intellectual Property
The Services, including the software, design, text, graphics, logos, trademarks, and all content other than User Content, are owned by MarriageEmporium or its licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended personal, non-commercial purpose in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer (except where this restriction is prohibited by law), or create derivative works of the Services without our prior written consent.
13. Third-Party Services and Links
The Services may integrate or link to third-party services (for example, Stripe for payments, screening providers, or independent counselors). Third-party services are governed by their own terms and policies, and we are not responsible for their content, acts, omissions, or availability.
14. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless MarriageEmporium and its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your User Content; (b) your use of the Services; (c) your violation of these Terms or of any law or third-party right; (d) your interactions, relationships, or dealings with any other member, including any meeting, engagement, or marriage; or (e) any misrepresentation made by you in your account, profile, marriage contract, or verification materials. We reserve the right, at your expense, to assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with our defense.
15. Disclaimers of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. MARRIAGEEMPORIUM EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT (A) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) ANY INFORMATION, SCORE, REPORT, VERIFICATION, OR BACKGROUND CHECK IS ACCURATE, COMPLETE, OR RELIABLE; (C) ANY MEMBER IS WHO THEY CLAIM TO BE OR WILL BEHAVE AS REPRESENTED; OR (D) YOUR USE OF THE SERVICES WILL RESULT IN ANY MATCH, RELATIONSHIP, ENGAGEMENT, OR MARRIAGE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) IN NO EVENT WILL MARRIAGEEMPORIUM OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, INCLUDING DAMAGES ARISING FROM YOUR INTERACTIONS OR RELATIONSHIPS WITH OTHER MEMBERS, WHETHER ONLINE OR OFFLINE; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS (US $100). THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR UNDER MANDATORY CONSUMER-PROTECTION RIGHTS.
17. Governing Law and Dispute Resolution
Governing law. These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles, except that mandatory consumer-protection laws of your country of residence remain unaffected where they cannot be waived.
Informal resolution first. Before filing any claim, you agree to contact us at customerservices@marriageemporium.com and attempt to resolve the dispute informally for at least 60 days.
Binding arbitration. Except for the matters in “Exceptions” below, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will be conducted in English, and the seat of arbitration will be Wilmington, Delaware; hearings may be conducted by video or telephone where permitted by the AAA Rules. The arbitrator may award any relief available in court on an individual basis, and the award may be entered as a judgment in any court of competent jurisdiction.
Class action and jury waiver.
YOU AND MARRIAGEEMPORIUM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL.
Exceptions. Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or equitable relief in court to protect intellectual-property rights or to prevent unauthorized access to or misuse of the Services.
Opt-out of arbitration. You may opt out of this arbitration agreement by emailing customerservices@marriageemporium.com within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and your account email. Opting out does not affect any other provision of these Terms.
Time limit for claims. To the extent permitted by law, any claim arising out of or relating to these Terms or the Services must be filed within one (1) year after the claim arose; otherwise it is permanently barred.
Consumers outside the United States. If you are a consumer in the EEA, UK, or another jurisdiction whose mandatory laws give you the right to bring proceedings in your home courts or prohibit mandatory arbitration, this Section applies only to the extent permitted by those laws and does not deprive you of any mandatory protection.
18. Termination
By you. You may close your account at any time through your account settings or by contacting us. Closing your account does not entitle you to a refund except as provided in the Payment Policy.
By us. We may suspend or terminate your account or access at any time, with or without notice, if you violate these Terms, if we reasonably believe your conduct may harm other members, us, or third parties, if required by law, or if we discontinue the Services (in which case we will refund any prepaid, unused subscription fees for the period after discontinuation).
Effect and survival. Upon termination, your right to use the Services ends immediately. Provisions that by their nature should survive — including Sections 2, 4, 8 (licenses as stated), 12, 14, 15, 16, 17, and 19 — survive termination.
19. International Use, Sanctions, and Translation
The Services are operated from the United States and offered globally. You are responsible for complying with local laws applicable to your use. You may not use the Services if you are located in, or are a national or resident of, a country or region subject to comprehensive U.S. sanctions, or if you appear on any restricted-party list. We may present translations of these Terms or the Services for convenience; the English-language version of these Terms controls to the extent permitted by law.
20. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page, update the “Last Updated” date, and provide advance notice of material changes by email or in-Service notification. If you do not agree to the updated Terms, you must stop using the Services and may close your account; your continued use after the effective date constitutes acceptance.
21. General Provisions
Entire agreement. These Terms, together with the Privacy Policy and Payment Policy, are the entire agreement between you and MarriageEmporium regarding the Services and supersede all prior agreements on the subject.
Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will remain in effect.
No waiver. Our failure to enforce any provision is not a waiver.
Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. There are no third-party beneficiaries to these Terms.
Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.
Notices. We may provide notices to the email address on your account; legal notices to us must be sent to customerservices@marriageemporium.com with the subject line “Legal Notice.”
